This User TERMS AND CONDITIONS (“T&C”) govern the use of the website (https://travalo.in) & application named “Travalo”, and their associated upgrades, patches, and updates and related services (hereinafter the “Platform”) currently provided or which will be provided by Nuideas Ventures LLP, a Limited Liability Partnership Firm incorporated under the Limited Liability Partnership Act, 2008 and having its registered office at CTS No 862, Flat No 2, Plot No 208 Raj Palace, Bhandarkar Road, Shivajinagar Pune Maharashtra 411004 , India (hereinafter the “Company” or “We” or “Our” or “Us”)

This T&C sets out the terms and conditions on which the Company makes the Products and services available to any person using, accessing, browsing the Platform, purchasing from the Platform through a desktop, mobile device, etc. (“User” or “You”) through the Platform and on which You may use the Platform. The Platform’s Privacy Policy, which can be found here,  forms an integral part of this T&C.

The Platform provides information about the various perfumes, fragrances, refillable & portable perfume atomizers (“Products”) and offers the Products to Users for purchase. The Platform also provides the User the facility to make online payment for the products purchased and the shipping of the purchased products to the Purchaser. The Platform also offers pre and post-sales Customer Service.  (hereinafter together referred to as “Services”)

Please note that only adult Indian citizens who are residents of India are permitted to register as Users of the Platform. You are advised not to apply for registration as a User if you are not an adult Indian citizen who is a resident of India.

By using the services of the Website, You agree to be bound by these T&Cs and the changes, amendments made therein from time to time.

The T&Cs shall be updated from time to time by the Company and it is therefore advised to regularly keep updated of the same.

The Company reserves the right to review, amend, and withdraw the T&C and services provided on the Platform without notice. You can determine when this T&C was last modified by referring to the “Last Updated” legend above. It shall be responsibility of the User to check the T&C along with the Privacy Policy periodically for changes/modifications. Accordingly, please continue to review the T&C along with the Privacy and Cookie Policy whenever accessing or using the Platform. It is advised to not proceed with the usage of the Platform if you do not agree to the above and following T&Cs.

1. Only adult Indian citizens who are residents of India are permitted to register as Users or Members of the Platform.
2. The Company reserves all rights to block, permanently disable, terminate, pause Your membership or account and access to the Platform or refuse service if You are found in breach of T&Cs or Privacy Policy.
3. Only the person deemed competent as per the Indian Contract Act, 1872 shall be eligible to access the Platform and avail the services offered.
4. Any minor wishing to transact and access the Platform shall do so through their legal guardian or parents only. If any minor accesses or avails any of the services offered by the Platform without supervision of their legal guardian or parents, the Company shall not be held liable in any capacity.
5. Any person who is representative of a company, partnership firm, organization or any sole proprietorship, shall be eligible to conduct transactions on behalf of such organization only if the person is duly authorized by the respective organizations as prescribed statutorily or by way of charter documents of such entity.
6. Any person accessing, browsing, using the Platform as a representative of any organization or third party, automatically binds such firm, third party to the Terms of Service and Privacy Policy of the Company.

2) Platform Use

• You are responsible to maintain confidentiality of your login credentials including the Login ID and password. Your account is non-transferable, and you shall not sell, trade, combine or otherwise share the account details with any other person.
• If you suspect or have reason to believe that your account has been breached, you shall immediately contact us on the email ID support@travalo.in.at the earliest to enable us to take appropriate action. The Company shall not be held liable for any loss or damage caused to You by such breach if you fail to notify the Company of such breach.
• You agree to have your information such as email address, phone number to be used by the Company to send you emails, messages of transactional, promotional and commercial use from the Company as required from time to time. You shall have right to unsubscribe to such service and can contact the Company for the same on the email ID support@travalo.in.
• By posting any content on the Platform, you hereby grant the Company a perpetual right to use such information exclusively in any form or media known or invented and used hereinafter anywhere in the world subject only to the Company’s Privacy Policy or any other laws for the time being in force.
• The Company does not regularly monitor comments or messages posted to the Platform by you but reserves the sole right to do so and if found inappropriate will take appropriate action including legal action with the right to report to the law enforcement or statutory authorities. The Company shall cooperate for investigation of any illegal activities being investigated with regard to the Platform in accordance with the laws for the time being in force.
• You are prohibited to do any such activity that shall violate or attempt to violate the security of the Platform so as to harm the Company operations, endanger other users in any way or do any such activity that shall be deemed illegal as per the laws applicable in India.
• You shall not
  1. create, use, share and/or publish by any means or through any medium, in relation to the Platform, any material (text, words, images, sounds, videos, etc.) which would result in a breach of confidentiality, infringe any intellectual property right or an individual’s right to privacy or which would incite the committing of an unlawful act (in particular, piracy, cracking or circulation of counterfeit software);
  2. You shall not modify, distort, block, abnormally burden, disrupt, slow down and/or hinder the normal functioning of all or part of the Platform, or their accessibility to other users, or the functioning of the Platform, or attempt to do any of the above;
• transmit or propagate any virus, trojan horse, worm, bomb, corrupted file and/or similar destructive device or corrupted data in relation to the Platform, and/or organize, participate in or be involved in any way in an attack on COMPANY’s servers and/or the Platform;

1. transmitting or communicating any material or content anywhere which, in the sole and exclusive discretion of the COMPANY, is believed or deemed untrue or offensive, including, but not limited to, language that is harmful, threatening, unlawful, abusive, harassing, defamatory, disparaging, obscene, sexually explicit, or racially, ethnically, or otherwise objectionable;
2. use the Platform for any activity deemed as illegal as per the laws of India
3. harass, threaten or intentionally defraud (or assist in defrauding) any other Users in the Platform;

• intentionally try to defraud (or assist in the defrauding of) the Company;
• falsely claim an endorsement in connection with the Platform or with Company

1. provide false, inaccurate, or misleading information;
2. trade taking advantage of any technical glitch, malfunction, failure, delay, default, or security breach;
3. take any action that interferes with, intercepts, or expropriates any system, data, or information;

• partake in any transaction involving the proceeds of illegal activity;
• collect any user information from other Users, including, without limitation, email addresses;

3) Terms of Offer of Products

1. 1. By placing an order of Products with us, you agree to these T&Cs.
   2. Unless agreed upon otherwise, You shall not resell or sell the Products. The Products offered for purchase by You are for personal use only.
   3. The Company reserves the right to discontinue, or modify or cancel any Product without notice or liability.
   4. The Company reserves the right to change the price of any Product or service as per its discretion at any time without notice or liability.
   5. The Company endeavors and strives to provide best possible accurate description of the Product on the Platform.
   6. For all the Products purchased from the Platform you shall be responsible to pay taxes applicable as per the law.

4) Order Fulfillment

1. Prices of products displayed on the Platform shall be inclusive of GST and delivery charges. The final price payable by you for purchase of the Product shall be visible at the checkout page and shall include delivery charges as applicable.
2. You shall be notified via electronic mail or an SMS text message acknowledging your purchase order and you shall be provided with an order number. Once we send this confirmation it is deemed that the order is accepted by the Company and shall be fulfilled subject to the T&Cs herein.
3. You shall receive an electronic mail or an SMS text message confirming the dispatch of the order once it is dispatched.
4. If due to any circumstances we are unable to fulfill your order, you shall receive notice of the same via electronic mail or an SMS text message.

5) Pricing, Availability and Payment

1. The sale of products on the Platform is subject to their availability.
2. The Company shall have sole discretion to decide the price of the Products offered for purchase on the Platform.
3. The offers and any promotional discounts are run at the discretion of the Company and are subject to change or discontinuation without notice.
4. The Company offers the following modes of payment:
   1. Online payment via payment gateway
   2. Cash on Delivery (COD)
5. The Company uses secure third-party platforms and payment gateways to process your payment online.
6. The Company shall not be liable whatsoever in respect of any loss or damage arising directly or indirectly to you for failure of transaction due to:
   1. Lack of authorization for any transaction/s or;
   2. Exceeding the Bank transaction amount limits or any such limit decided mutually between you and the Bank

Any payment issues arising from transactions or decline of any transaction for any reason.

1. By conducting the transactions through the Platform you specifically authorize the Company, Platform and the Payment Service Providers to collect process, facilitate, remit payments and / or the Price electronically or through Cash on Delivery to and from Users.
2. Cash on Delivery facility shall only be provided for orders less than INR 25,000/-.

6) Cancellation, Refund/Return Policy

Cancellation

1. In order to cancel your Order, You shall send us an email on the following email ID support@travalo.in within 24 hours.
2. You will receive a confirmation of the cancellation of your order via electronic mail or SMS text message.
3. Once you receive the confirmation of cancellation, the amount paid for purchase of the product will be credited into the same payment mode using which payment for the order initially was made.
4. Cancellation requests received after 24 hours shall not be accepted

Return/Refund

1. Our shipments are carefully inspected, and reasonable care is taken before products are shipped.
2. User shall be responsible for inspecting the Products at the time of accepting delivery of the same. Any complaints regarding the Product shall be raised as far as possible at the time of delivery itself.
3. The Company shall not be responsible for any damage, direct or indirect loss suffered by You or any third party due to any negligence or breach of these T&Cs by the User.
4. User shall raise return request within 7 days from the delivery date, via electronic mail to support@travalo.in. Such request shall contain all relevant details of the return including the reason for return and such other details as required by the Company for verification of the request.
5. Any request for return of Product shall be verified by the Company. Approval of return requests is solely at the discretion of the Company subject to the verification of the request.
6. Return and refund or replacement of product shall only be done in the following cases:
   1. in case of breakage or leakage of the Product
   2. wrong Product delivered

1. You shall receive the refund of the entire amount paid by You after deduction of shipping charges. The refund shall be processed within 7 to 8 business days after the return request is verified and the Product is returned to the Company.
2. Return request shall not be accepted once product is used.
3. In case of refund/return/replacement of the Product the Company has pick-up facility for most of the locations across India. For the locations where the pick-up facility is not available, User shall bear the costs required to return the Product. The costs shall include inter-alia packaging shipping and any other costs required for the Product to reach the Company. The cost of returning the Product shall be borne by You.
4. Address for returning the Product shall be provided along with the Product.
5. In case the return is from a combo offer or any offer wherein two or more products are offered together for sale by the Company, then you shall return the entire order and not just single product thereof.

7) Shipping of the Product

3. 1. The Company has partnered with reputed third-party vendors for shipping of its Products to ensure timely and safe delivery of its Product to you.
   2. Based on the location of your delivery, the Products shall be delivered within 7 to 8 business days from the date of the order placed.
   3. Details of the shipment shall be sent to you via e-mail or SMS text message.
   4. You shall be able to track your order from our courier agents tracking page using the details provided as mentioned in Cl. 8(c).
   5. The Company shall not be responsible for any delay in delivery of the Product by the shipping vendor caused by unforeseen circumstances, or your unavailability at the time of delivery.

8) Disclaimer

1. The Platform is provided to you on “as is” or “as available” basis. The Company makes no representations or warranties regarding the use or result of the contents displayed on the Platform in terms of their accuracy, correctness, reliability or otherwise.
2. The Company shall not be responsible or liable for any loss or damage suffered by you in any manner as the result of direct or indirect depiction of the content displayed on the Platform.
3. The Company is not liable for any loss or damage suffered by you due to posting of any information or user generated content and sharing the same on the Platform.
4. The Company can suspend the operation of the Platform without notice for the purpose of maintenance, improving the user experience, updating the Platform or any other purpose as the Company sees fit for ensuring the smooth and secure operation of the Platform.
5. You are solely responsible for all the information shared by you to any other user of the Platform and content you post on the Platform.
6. Please note that not all the Platform Services are available in all geographical areas and depending on Your location, You may not be eligible to avail certain Platform Services.
7. Platform may contain information about or hyperlinks to third party websites. In such cases, Company shall not be held responsible in any manner and do not extend any express or implied warranty to the accuracy, integrity or quality of the content belonging to such third-party websites or apps or for any content posted on any third-party website.
8. Further, the involvement of Company with any of the third-party content or links to third-party Internet sites is not related to any sort of endorsement by Company of such third-party Internet site. If you rely on any third-party Content posted on any website or app which does not belong to us, you may do so solely at your own risk and liability.
9. Company or Platform is neither associated with nor responsible for the correspondence, transactions, and all other related activities between the user and third parties including payment gateway providers and verification service providers of the Platform. Your involvement with third parties is entirely dependent on the terms and conditions, policies and services terms of these third parties and the users are solely responsible for reviewing the policies, terms and conditions, and the service terms of these third parties before transacting or availing any of the services.

9) INTELLECTUAL PROPERTY

1. The Platform and all information, content, materials, products including, but not limited to text, content, photographs, graphics, texts, video and audio content and computer code (“Content”) on the Platform is owned and controlled by the Company and the design, structure, selection and feel and arrangement of the Content is protected by copyright, patent and trademark laws and other various intellectual property rights either in the favour of the Company, or third parties from whom the appropriate permissions have been taken under applicable laws. The trademarks, logos and service marks displayed on the Platform (“Marks”) are the property of the Company or other respective third parties, as the case may be. You are not permitted to use the Marks without the express prior written consent of the Company or the third party that owns the Marks.
2. Further, You understand and accept that all information, except Your personal information and other data submitted by You for the purposes of availing the Platform Services shall be deemed to be the property of the Company, and the Company shall be free to use any ideas, concepts, know-how or techniques provided by You on the Platform, in any manner whatsoever.

10) Warranty

1. Any product bought from the Travalo segment of the Platform may have a warranty of 1 year from the date of purchase.
2. Any product bought from the Perfume Pod segment of the Platform may have a warranty of the 6 months from the date of purchase.
3. The warranty if availed is subject to the cancellation, return/ refund policy mentioned herein.

11) Force Majeure

If the product deliveries are delayed or failed for any reason from the events or circumstances which are outside its reasonable control, neither of the parties will be held responsible for it (controls shall also include strikes, act of God, lock outs, accidents, breakdown of plant/machinery/shortage/unavailability of raw materials from a natural source of supply, and war). In case of unreasonable time is taken for the delivery you may raise the cancellation, refund request with the Company. Such request is subject to the procedure mentioned in Cancellation, Refund/ Return Policy mentioned herein.

12) Governing Law and Jurisdiction

Any disputes arising out of the use of the Platform shall be governed at as per the applicable laws in India and jurisdiction of the court shall be at Pune, Maharashtra.

13) Grievance Redressal

In accordance with Information Technology Act 2000 and rules made thereunder, if you have any complaint or question please write to us at support@travalo.in. The concerned authority shall get in touch with you in 5-7 business days.

The Company reserves all other rights.
